The Catholic Church proscribes methods of birth control other than sexual abstinence. Although the U.S. Food and Drug Administration (FDA) recognizes abstinence as an acceptable method of birth control in research studies, some pharmaceutical companies mandate the use of artificial contraceptive techniques to avoid pregnancy as a condition for participation in their studies. These requirements are unacceptable at Catholic health care institutions, leading to conflicts among institutional review boards, clinical investigators, and sponsors. Subjects may feel coerced by such mandates to (...) adopt contraceptive techniques inconsistent with their personal situation and beliefs; women committed to celibacy or who engage exclusively in non-heterosexual activities are negatively impacted. We propose principles to insure informed consent to safeguard the rights of research subjects at Catholic institutions while mitigating this ethical conflict. At the same time, our proposal respects the interests of pharmaceutical research agencies and Catholic moral precepts, and fully abides by regulatory guidance. (shrink)

If stem cell-based therapies are developed, we will likely confront a difficult problem of justice: for biological reasons alone, the new therapies might benefit only a limited range of patients. In fact, they might benefit primarily white Americans, thereby exacerbating long-standing differences in health and health care.

We report on the deliberations of an interdisciplinary group of experts in science, law, and philosophy who convened to discuss novel ethical and policy challenges in stem cell research. In this report we discuss the ethical and policy implications of safety concerns in the transition from basic laboratory research to clinical applications of cell-based therapies derived from stem cells. Although many features of this transition from lab to clinic are common to other therapies, three aspects of stem cell biology pose (...) unique challenges. First, tension regarding the use of human embryos may complicate the scientific development of safe and effective cell lines. Second, because human stem cells were not developed in the laboratory until 1998, few safety questions relating to human applications have been addressed in animal research. Third, preclinical and clinical testing of biologic agents, particularly those as inherently complex as mammalian cells, present formidable challenges, such as the need to develop suitable standardized assays and the difficulty of selecting appropriate patient populations for early phase trials. We recommend that scientists, policy makers, and the public discuss these issues responsibly, and further, that a national advisory committee to oversee human trials of cell therapies be established. **NB we did not reccommend a NAC, we think it might be appropriate**. The “New Natural Law” Theory (NNL) of Germain Grisez, John Finnis, Joseph Boyle, and their collaborators offers a distinctive account of intentional action, which underlies a moral theory that aims to justify many aspects of traditional morality and Catholic doctrine. -/- In fact, we show that the NNL is committed to premises that entail the permissibility of many actions that are irreconcilable with traditional morality and Catholic doctrine, such as elective abortions. These consequences follow principally from two aspects of (...) the NNL. The first aspect is its distinctive version of the planning theory of intention, in which adopting the 'first-person perspective' of an agent is a sufficient, and not merely necessary, condition for determining the nature of his intentional action; this planning theory rests upon an implicitly Cartesian conception of human behavior, in which behavior chosen by an agent has no intrinsic “intentionalness” apart from what he confers upon it as part of his plan. The second aspect is the NNL's distinctive account of basic human goods' incommensurability, according to which there is no common factor shared by basic human goods that allows them to be comparatively ranked in any way that directs practical deliberation. -/- The entailments of these two aspects of the NNL, we argue, amount to a reductio ad absurdum. Pace the proponents of the NNL account, we sketch an alternative hylomorphic conception of intentional action that avoids untoward moral implications by grounding human agency in the exercise of basic powers that are either (a) essential constituents of human nature or (b) acquired through participation in social practices. In Intention and her subsequent essays that addressed human action, Elizabeth Anscombe made signal contributions to the Aristotelian-Thomistic tradition, and to western philosophy more broadly. The new natural law theory of Germain Grisez, John Finnis, Joseph Boyle, and their collaborators mistakenly claims to be consonant with Anscombe’s work. A central reason for this misappropriation lies in the failure to understand the ways in which Anscombe does and does not deploy a “first-person perspective” in analyzing intentional action. O'Brien, Roderick Among the treasures at the Congregational Archives of the Sisters of St Joseph of the Sacred Heart in North Sydney is a booklet, a hymnal: a collection of hymns and sacred songs attributed to Fr Julian Tenison Woods.1 The purpose of this short article is to introduce one of those hymns, and provide some information about poetry and songs in Woods's life and mission. I am grateful to the archivist for making this booklet available. Introducing this particular (...) hymn, 'Longing to Go', also gives us some insight into Woods's spirituality regarding death and regarding mission. (shrink)

There was a significant monetary cost associated with establishing Catholicism in colonial Western Australia. The bishops and clergy funded the development of the local Catholic Church through donations from European benefactors, offerings from the congregation, and sponsorship from the Colonial and British Governments. As donations from Europe were variable and the resident Catholic population were largely poor, the government grants were the most reliable income for the Diocese of Perth. The government issued grants to support the establishment of congregations, schools, (...) and social welfare institutions. The development of congregations in new settlements was the Catholic Church's core ministry and the government issued stipends to Catholic chaplains to administer spiritual care to settlers and convicts in particular districts. Government grants were based on the census results and the Catholic Church was required to establish local church congregations and recruit clergy, and demonstrate an ability to contribute towards the maintenance of both. From 1852 to 1886, Bishops Joseph Serra, Rosendo Salvado and Martin Griver took charge of establishing congregations, managing clergy and lobbying the governors and other civil officials to fund colonial chaplaincies. The government also expected that the chaplains would promote moral and social order among the ex-convicts transported from Britain. (shrink)

There is a rather disturbing argument that it is wrong for us ever to smile and be glad, in light of our knowledge of horrors happening everywhere all the time. The paper's primary aim is to respond to the challenge this argument presents and to see what can be said for being happy in spite of it. Drawing from the works of Tolstoy, Joseph Butler, and others, the author develops two or three lines of response to the argument against (...) happiness. One line of response makes heavy use of what human nature is like and what some of our limitations are. The second line of response considers the consequences of the fact that we naturallycease to be moved by things we are used to. The third line explores the idea that it is justifiable to be happy in the midst of suffering if you yourself are sufferingtoo. The author believes that these lines of argument may answer to some degree the argument against happiness. (shrink)

Abstract:This article examines unrecognized points of conceptual and stylistic convergence between the work of Flann O'Brien and Ludwig Wittgenstein. Though operating in quite different generic and discursive modes, both writers critique impulses to metaphysical systems, idealized models of language, and skepticism. O'Brien and Wittgenstein adopt as correctives to these tendencies techniques to train their readers' attention on the zones of overlap in linguistic usage where points of confusion tend to arise. Finally, this comparison with O'Brien casts new light on Wittgenstein's (...) later work as it illuminates satirical and ironizing styles that have often been overlooked. (shrink)

The concepts of time and identity seem at once unproblematic and frustratingly difficult. Time is an intricate part of our experience -- it would seem that the passage of time is a prerequisite for having any experience at all -- and yet recalcitrant questions about time remain. Is time real? Does time flow? Do past and future moments exist? Philosophers face similarly stubborn questions about identity, particularly about the persistence of identical entities through change. O'Brien & Opie's admirably sharp hypothesis gains some of its force by ignoring distinctions in murky areas. I attempt to agitate the waters by suggesting that process and vehicle theories are not so different, that classicism can support a vehicle theory, and that several of the key concepts underlying their theory are less clear than depicted. The connection to information I find especially tenuous. Finally, I address the implications of their theory for unconscious thought.

Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. The unfinished Scito teipsum (“Know thyself,” also known as the “Ethics”; c.1138) analyses moral action. (shrink)

This paper considers masculinity in two twentieth-century historical novels set in the eighteenth century: Andrew Miller’s Ingenious Pain (1997) and Hilary Mantel’s The Giant, O’Brien (1998). It argues that both novels create protagonists who embody masculine-coded attributes, including resistance to pain and bodily size and strength, and that, in both novels, earning potential is concomitant with such attributes. Complicating matters, however, the very exaggeration of stereotypical masculine characteristics in these texts causes each man to seem something other and (...) less than a man—ranging for both, at different times, from monstrous to pathetically weak (and childlike, or even womanish) victim. Qualities associated with manhood, therefore, paradoxically deny the men more agency than they allow in these stories set in the eighteenth century, inhibiting them from enjoying ideal manhood and making them the property of other men. It is difficult to imagine anyone better to write this book than James Crimmins. As a leading Bentham (...) scholar, among his twelve previously published books on utilitarianism, he is editor of the Bloomsbury Encyclopedia of Utilitarianism (Bloomsbury, 2013) and the four-volume set Utilitarians and Their Critics in America, 1789–1914 (Thoemmes Continuum, 2005). His vast knowledge of the history of utilitarianism, which he has spent his entire career investigating, makes him the perfect author for this very helpful book on the influences of utilitarianism in early American thought. It is a rich sourcebook that can help direct anyone looking to do more research in this area. Here, Crimmins provides a thorough historical account of the influence of utilitarianism on the development of early American thought and the rise of pragmatism, giving reason to believe that utilitarianism was more impactful on American pragmatism than is often realized.The first chapter highlights why utilitarian influence on American law and politics is overlooked and why it should not be. Chapters 2 and 3 explain how American thought leaders came to know of Bentham's work, and chapters 4–7 discuss concrete examples of thinkers who brought utilitarianism to bear on issues in America (for example, Hoffman on legal studies in chapter 4, Livingston on legislative law in chapter 5, the death penalty debate in chapter 6, and Thomas Cooper's wide-ranging influences in chapter 7). The epilogue provides a specific set of arguments for why the utilitarians' influence on American Pragmatism should be more widely recognized and investigated.Crimmins begins the book by explaining why utilitarianism, as an influence in early American politics, is typically excluded and ignored by thinkers from John Dewey to Élie Halévy. One reason is that William Paley's Principles of Political and Moral Philosophy (which was used widely as a moral text in US universities throughout the 1800s) was published in 1785, and Bentham's An Introduction to the Principles of Morals and Legislation was published in 1789, and even then Bentham's ideas didn't gain public circulation (and then only in French) until Etienne Dumont published the three-volume Traités de législation civile et pénale in 1802. Nutt (Ave Maria, FL: Sapientia Press, 2021), ix + 422 pp.This volume is a collection of papers presented at the "Thomas Aquinas and the Crisis of Christology" conference (...) at the Aquinas Center of Ave Maria University in Ave Maria, Florida, in February 2020. Dozens of papers were presented at the conference; this volume contains many of the plenary papers and the two keynote addresses given by Bruce Marshall and Thomas Joseph White, O.P.The title, especially the term "crisis," has multiple meanings in the essays. On the one hand, some of them address the crisis in contemporary Christology. For example, Michael Dauphinais draws on Aquinas's theology of participation to pose what he sees as a better alternative to Richard Rohr's The Universal Christ. As Dauphinais shows, Rohr's popular Christology conflates Incarnation and creation as one and the same reality. Through careful exegesis of Aquinas's Commentary on John, Dauphinais argues that the Incarnation must be distinct as a unique act of God, and thus decidedly not the same as creation (253). On the other hand, as J. Augustine DiNoia observes in his foreword, the term "crisis" comes from the Greek krisis, or "judgment" (ix). Christ's judgment of all human beings emerges as a persistent theme in the volume. So Andrew Hofer's introduction explores Aquinas's teaching on Christ's judgment of teachers of the faith, noting the implications for theologians who hold the office of teacher. Marshall's and Daria Spezzano's essays are powerful accounts of Christ's role as judge. Both diagnose contemporary crises of faith over which we will be judged and remind us that the Lord Jesus judges to save those who love him. These essays read almost like sermons, and they deserve careful attention when [End Page 1435] Christ's judgment seems irrelevant in an age when God can only be thought to be winsome and nice.Some of the essays contribute to ongoing Thomistic scholarly debates. The vexed question of how to understand the esse secundarium in article 4 of Aquinas's De unione verbi incarnati receives two essays: one by Roger Nutt and the other by Steven A. Long. Nutt argues that Aquinas did not reverse his teaching on the single esse of Christ in the De unione. He observes that Aquinas uses the terms principale and secundarium to manifest "the ultimate unity of composite realities," and thus secundarium esse is not "second esse" in the order of being (87). Like Nutt, Long argues that Aquinas is consistent in his position on Christ's singular esse. He invokes a wide array of interpretive and metaphysical arguments in a mere nine pages. Though they do not resolve the problem (at least in my view: how could an esse distinct from another esse be numerically the same esse, as they would have to be for Christ to have one esse?), they are useful contributions to the ongoing interpretation of Aquinas on this point.Similarly, Christ's human knowledge in Aquinas's theology and Catholic doctrine gets two essays. White expands on prior work on this topic and argues that Christ maintained consciousness of his filial identity prior to the resurrection. As usual, he does careful work deploying the insights of Catholic doctrine in conversation with biblical studies. Simon Francis Gaine expands on his argument in Did the Saviour See the Father? Christ, Salvation and the Vision of God by arguing that a divine person does not need to have the beatific vision to be incarnate. He contrasts metaphysical necessity with soteriological necessity; Christ needed to have the beatific vision to give it to us, but he did not need it as a necessary consequence of being incarnate. It would be interesting to see Gaine and other Thomists interact with John Duns Scotus's argument that Christ could be incarnate without the beatific vision, or highest possible grace (Ordinatio III, d. 13). In this paper I want to propose that we see solipsism as arising from certain problems we have about identifying ourselves as subjects in an objective world. The discussion will centre on Wittgenstein’s treatment of solipsism in his Tractatus Logico- Philosophicus. In that work Wittgenstein can be seen to express an unusually profound understanding of the problems faced in trying to give an account of how we, who are subjects, identify ourselves as objects in the world. We have in his (...) compressed remarks, the kernels of a number of arguments which all come together to form what can be called the problem of self-identification. I want to argue that the solipsism of the Tractatus arises at least in part as a solution to, or – to put it less optimistically – as a symptom or articulation of this problem. In approaching Wittgenstein’s early discussion of solipsism in this way I will obviously be in disagreement with some other interpretations of the work. For example, there are those who think that there is no ‘solipsism of the Tractatus’.1 In fact, the Tractarian arguments presented below as motivating solipsism have been seen as fulfilling the quite opposite function of refuting it. I do not intend in this piece to engage with alternative interpretations. Let me say a little bit about why I have granted myself the licence not to do so. First, the focus of my concern with solipsism is on how it connects with what I have called the problem of self-identification. How is it that we think and refer in the first-person way? For most philosophers in the analytic tradition, the problem is essentially this: how two apparently conflicting kinds of properties can be reconciled and united as properties of the same entity. What is special about the first person has to be reconciled with what is ordinary about it. The range of responses reduces to four basic options. The orthodox view is optimistic: there really is a way of reconciling these (...) apparently contradictory properties as contained within the same thing. The essays investigate what mental actions are, how we are aware of them, and what is the relationship between mental and physical action.

Directed panspermia is the deliberate seeding of lifeless planets with microbes, in the hopes that, over evolutionary timescales, they will give rise to a complex self-sustaining biosphere on the target planet. Due to the immense distances and timescales involved, human beings are unlikely ever to see the fruits of their labours. Such missions must therefore be justified by appeal to values independent of human wellbeing. In this paper I investigate the values that a directed panspermia mission might promote. Paying special (...) attention to the outcome in which sentient animals evolve, I argue that we have strong reasons to believe the value of a mission would be negative. Research on wild animal suffering has shown that there is a huge amount of suffering among wild animals on Earth. I argue that there are structural features of evolution by natural selection which explain the prevalence of suffering on Earth, and make it predictable that suffering would prevail on the target planet too. Finally, using insights from procreative ethics I argue on non-consequentialist grounds that creators have duties to their sentient creations which cannot be met in directed panspermia missions. It has been widely accepted that intentional actions are “the actions to which “a certain sense of the question ‘why?’ is given application” (Anscombe 1957/2000: 9). But there are robust reasons for thinking that this claim is false. First, there are intentional actions for which such questions are unsound. We have good reasons for thinking that the questions are not “given application” in these cases. Second, when these questions are “given application” this is best explained, it is argued, not in (...) terms of a necessary link between intentional action and this type of enquiry, but in terms of the fact that this is an enquiry that we pursue when we take an agent to have exercised certain of their rational capacities. The 2015 Paris Agreement set a global warming limit of 2°C above preindustrial levels. Corporations play an important role in achieving this objective, and methods have recently been developed to map global climate targets to specific industries, and individual corporations within those industries. In this article, we assess whether Sustainability ratings capture corporate performance in meeting the 2°C target. We analyze nine rating schemes used by investors and three commonly used in academic studies. Most rating schemes do consider corporate greenhouse (...) gas emissions in their analysis, whereas only a minority scale emissions by factors that have the potential to allow benchmarking against science-based targets. None take the final step of mapping climate indicators against the 2°C target. Furthermore, we find a lack of consistency in the climate change ratings of the databases used in academic studies. These results are concerning in the context of being able to meet global climate change goals. (shrink)

Heidegger's thinking in the decades following the publication of Being and Time is often deemed irreconcilable with that work. Critics contrast the notion of "resoluteness" in Being and Time with Heidegger's post-war account of "releasement" in an attempt to establish a discrepancy between the allegedly voluntarist humanism of his early work and the supposedly 'anti-humanist' thinking of his later work. By contrast, Mahon O'Brien argues for the structural and thematic coherence of Heidegger's movement from authenticity to the search for an (...) authentic free relation to the world - as captured by the term "releasement". By demonstrating the structural and thematic unity of Heidegger's thought in its entirety, O'Brien paves the way for a more measured and philosophically grounded understanding of the issues at stake in the Heidegger controversy. While much has been written about the functional profile of intentions, and about their normative or rational status, comparatively little has been said about the subjective authority of intention. What is it about intending that explains the ‘hold’ that an intention has on an agent—a hold that is palpable from her first-person perspective? I argue that several prima facie appealing explanations are not promising. Instead, I maintain that the subjective authority of intention can be explained in terms of the inner (...) structure of intention. In adopting an intention the agent comes to see herself as criticizable depending on whether she executes the intention. This allows us to explain in first-personal terms why the agent becomes disposed to act and deliberate in ways that are characteristic of intention. As intention-formation involves profound changes to reflexive evaluative attitudes, this is the ‘Self-Evaluation’ view of the subjective authority of intention. (shrink)

In Just Fodder, Milburn argues for a relational account of our duties to animals. Following Clare Palmer, he argues that, though all animals have negative rights that we have a duty not to violate, we only gain positive obligations towards animals in the contexts of our relationships with them, which can be personal or political. He argues that human beings have collective positive duties towards domesticated animals, in virtue of the kind of relationship between us established by domestication. I argue that throughout history and even prehistory human beings have morally entangled themselves with wild animals sufficiently that we may in fact have collective positive duties towards many, if not all, wild animals. Doctors have an ethical and legal duty to respect patient confidentiality. We consider the basis for this duty, looking particularly at the meaning and value of autonomy in health care. Enabling patients to decide how information about them is disclosed is an important element in autonomy and helps patients engage as active partners in their care.Good quality data is, however, essential for research, education, public health monitoring, and for many other activities essential to provision of health care. We discuss whether (...) it is necessary to choose between individual rights and the wider public interest and conclude that this should only rarely be necessary. The paper makes some recommendations on practical steps which could help ensure that good quality information is available for work which benefits society and the public health, while still enabling patients’ autonomy to be respected. Lucy O'Brien argues that a satisfactory account of first-person reference and self-knowledge needs to concentrate on our nature as agents. Clearly written, with rigorous discussion of rival views, this book will be of interest to anyone working in the philosophy of mind and action.

This paper addresses the question “what connection is there between our answer to the question of what we are, and the question, what our actions are?” Suppose that actions are reflexive changes of agents. On that supposition, there would be a direct connection between the answers to those two questions. An action of mine will be a reflexive change of me, and what I am will fix the nature of those changes. I hold that supposition to be true and consider (...) reasons in favor of believing it. However, the paper is not primarily aimed at defense of that thesis. It rather concerned with exploring what consequences accepting it has for the competing notions of what we are, given what we ordinarily think actions are, and bringing to light a tension between thinking of actions as reflexive changes of agents in this way, and a kind of causal understanding of actions that is prevalent. What emerges is that we should shift where we start our theorizing: we cannot assume that action theory primarily involves the task of characterizing the relation between an agent and changes caused, rather than a characterization of a particular kind of relation between the agent and herself. ABSTRACT This paper argues that the retort ‘easy for you to say’ is a complaint about the target’s standing, but that it invokes a standing norm that is unjustified. Moreover, I argue that in many cases the person for whom it is ‘easy to say’ should speak.
